Terms and Conditions

Calm the ADHD Storm Community

1. ABOUT THIS AGREEMENT

These terms and conditions govern your subscription to Calm the ADHD Storm, an online ADHD coaching community run by Alannah Aiken (ABN 84 421 834 475) of Victoria, Australia (referred to throughout as the Host).

By joining the subscription and making your first payment, you confirm that you have read, understood and agree to be bound by these terms in full. If you do not agree, you should not proceed with your membership.

Platform:  Ivorey Pty Ltd, delivered via the Kollab App

Membership:  Calm the ADHD Storm Community

Eligibility:  Open to individuals aged 18 and over

Monthly fee:  $39 AUD per month (billed by direct debit, pricing effective 26 April 2025)

2. ELIGIBILITY

To join this membership you must:

  • Be 18 years of age or older

  • Be an individual person. Membership is not available to businesses, organisations or entities

  • Agree to these terms in full before joining

  • Be able to enter into a legally binding agreement under the laws of your country of residence

By joining, you confirm that you meet all of the above requirements. The Host reserves the right to terminate a membership without refund if it is found that a member does not meet the eligibility criteria.

3. WHAT IS INCLUDED IN YOUR MEMBERSHIP

Your active membership includes access to the following:

  • 1 x group ADHD coaching and education call per month, held online

  • 1 x bi-monthly body doubling accountability call, held online

  • Access to the online community hub via the Ivorey platform and Kollab App

  • A growing library of ADHD resources and educational materials

  • Access to replays of all recorded calls for the duration of your active membership

All group calls are recorded. Replays are available to active members only and are accessible through the Ivorey platform. Access to replays and the content library ends when your membership ends.

The Host reserves the right to adjust, add to or modify the membership deliverables from time to time. Where a change represents a material reduction in what is offered, members will be given at least 30 days written notice and the option to cancel without penalty.

4. WHAT IS NOT INCLUDED

This membership does not include:

  • One-on-one coaching sessions with the Host

  • Personalised coaching plans or individual goal setting outside of group sessions

  • Mental health treatment, diagnosis or therapeutic support of any kind

  • Medical, legal, financial or any other professional advice

  • Guaranteed outcomes, results or improvements of any kind

  • Direct messaging access to the Host outside of the community platform

5. FEES, BILLING AND PAYMENT

Membership fees are billed in advance by direct debit to a nominated bank card on a monthly, quarterly or annual basis depending on the plan selected at the time of joining. All fees are in Australian dollars (AUD).


Billing cycle

  • Monthly memberships are billed every 30 days from the date of joining

  • Quarterly memberships are billed every 3 months from the date of joining

  • Annual memberships are billed every 12 months from the date of joining


GST is not currently charged. If this changes, members will be notified at least 30 days in advance.

If you are joining from outside Australia, you are responsible for any international transaction fees, currency conversion costs or other charges applied by your bank or card provider. The Host is not responsible for these costs.

Price changes

The Host reserves the right to change membership fees at any time. Members will be given at least 30 days written notice of any price increase before it takes effect. Continuing your membership after that date constitutes acceptance of the new pricing. If you do not wish to continue at the new price, you may cancel in accordance with clause 6.

Failed payments

If a payment fails, access to the membership may be suspended until the outstanding amount is cleared. It is the member's responsibility to ensure their payment details are kept current. The Host is not responsible for any disruption to access caused by a failed or declined payment.

6. ACCOUNT SECURITY

When you join, you will create an account on the Ivorey platform. You are responsible for maintaining the security and confidentiality of your login credentials at all times.


You agree that you will:

  • Not share your login details with any other person

  • Not allow any other person to access the membership using your account

  • Notify the Host immediately at alannah@alannahaiken.com if you believe your account has been accessed without your authorisation

The Host is not liable for any loss or damage arising from unauthorised access to your account where that access resulted from your failure to keep your login details secure. Any activity that occurs under your account is your responsibility.

7. MINIMUM COMMITMENT, CANCELLATION AND ACCESS

Minimum commitment period

All memberships carry a minimum commitment period of 3 months from the date of joining. This minimum period exists to support members in getting set up, showing up consistently and giving the community a genuine chance to work for them. Cancellation requests received within the first 3 months may not be accepted and membership fees will continue to be charged for the remainder of that 3 month period.

How to cancel

After the 3-month minimum period, members may cancel at any time by sending a written cancellation request to alannah@alannahaiken.com. Cancellation requests must be received before the next billing date to avoid being charged for the following period.

When access ends

Cancellation is not immediate. Once a cancellation request is accepted, your membership will remain active until the end of the current billing period already paid for. You will not be charged again after that and your access will end when that period closes.

No pausing

Memberships cannot be paused. If a member needs to take a break, the membership will need to be cancelled and rejoined at the then current price when they are ready to return.

No transfers

Memberships are personal and non-transferable. They cannot be gifted, sold or transferred to another person under any circumstances.

8. REFUND POLICY

Given the digital and ongoing community nature of this membership, the following refund policy applies:

  • Fees already paid are non-refundable except where required under the Australian Consumer Law

  • No refunds will be issued for periods of non-use, inactivity or because a member has not engaged with the content or community

  • No refunds will be issued during the 3-month minimum commitment period

  • If the Host permanently closes the membership program, a pro-rata refund will be issued for any unused portion of a prepaid billing period

Under the Australian Consumer Law, members retain consumer guarantee rights that cannot be excluded. Nothing in these terms limits any rights you hold under the ACL that cannot lawfully be excluded.

9. NATURE OF ADHD COACHING AND NO GUARANTEE OF RESULTS

The content, calls and resources provided through this membership are ADHD coaching and education in nature. They are not therapy, counselling, psychology, psychiatry or any form of clinical or medical treatment.

The Host makes no guarantee, representation or warranty regarding any outcome, result or improvement arising from participation in this membership. This includes but is not limited to improvements in focus, productivity, emotional regulation, relationships, career outcomes or any other area of life.

The member acknowledges and agrees that:

  • Results depend entirely on the member's own engagement, effort and follow-through

  • The Host is not responsible or liable for any action taken or not taken by a member as a result of content, coaching, community interaction or any other aspect of the membership

  • The Host is not liable for any decision made by a member based on information shared within the membership, whether by the Host or by other members

  • ADHD coaching does not replace professional medical, psychological or therapeutic support

  • Any information shared in this membership is general in nature and is not tailored individual advice

10. EMOTIONAL WELLBEING AND THE COACHING PROCESS

ADHD coaching and community spaces can bring up personal reflections, emotions and challenges. This is a normal part of the process. The Host will always approach the community with care but is not a therapist and cannot provide individualised emotional or psychological support.

If at any point a member feels they need support beyond the scope of this membership, it is their responsibility to seek that support from a qualified professional. The Host will always refer members to appropriate support where a concern falls outside the coaching scope.

11. MEMBER RESPONSIBILITIES

By joining, each member agrees to:

  • Engage with the community respectfully and in good faith

  • Take personal responsibility for their own actions, decisions and outcomes

  • Keep their payment details current and ensure payments are processed on time

  • Keep their account login credentials secure and not share access with others

  • Not share, distribute, copy or reproduce any membership content outside of the platform

  • Comply with the Community Code of Conduct set out in clause 12

  • Notify the Host promptly of any concerns about the membership or community

12. COMMUNITY CODE OF CONDUCT

Calm the ADHD Storm is designed to be a safe, supportive and encouraging space for people with ADHD. All members are expected to treat each other and the Host with respect at all times.

The following behaviours will result in immediate removal from the membership without refund:

  • Sharing another member's personal disclosures, stories or information outside of the community platform

  • Bullying, harassment or targeted negative behaviour toward any member or the Host

  • Sharing, distributing, copying or reproducing any paid membership content outside of the platform

  • Hate speech, discrimination or language that demeans any person based on their identity, background, health or any other characteristic

  • Threatening, intimidating or abusive behaviour of any kind

  • Soliciting or promoting products, services or external communities without prior written permission from the Host

The following behaviours may result in a warning followed by removal if the behaviour continues:

  • Persistent negativity or commentary that undermines the supportive nature of the community

  • Unsolicited advice-giving that overrides or contradicts the Host's coaching guidance

  • Repeatedly ignoring community guidelines after being reminded

  • Behaviour that a reasonable person would consider disruptive, disrespectful or damaging to the community environment

The Host has sole discretion in determining what constitutes a breach of this code and in deciding the appropriate response. Decisions regarding warnings and removal are final.

13. MEMBER-TO-MEMBER INTERACTIONS

Members of this community will interact with one another through the Ivorey platform. The Host is not responsible for any advice, information, opinions or content shared between members.

The Host does not monitor all member-to-member interactions and cannot be held liable for anything shared, said or done by one member in relation to another. Members interact with each other at their own discretion and risk.

If a member experiences behaviour from another member that breaches the Community Code of Conduct, they should report it to the Host in writing at alannah@alannahaiken.com as soon as possible.

14. CONTENT, INTELLECTUAL PROPERTY AND CONFIDENTIALITY

All content created and shared by the Host within this membership, including calls, recordings, resources, frameworks, written materials and any other deliverables, is the intellectual property of Alannah Aiken and is protected by copyright.

Members agree that they will not:

  • Share, distribute, copy, reproduce or repurpose any membership content outside of the platform for any purpose

  • Share login credentials or provide platform access to any person who is not a paying member

  • Use membership content for commercial purposes of any kind

Members also agree to treat what is shared within the community as confidential. Personal disclosures made by other members are not to be shared, discussed or referenced outside of the platform. What is shared in the community stays in the community.

Breach of this clause may result in immediate removal from the membership without refund and may give rise to legal action.

15. THE IVOREY PLATFORM, KOLLAB APP AND THIRD PARTY SERVICES

This membership is delivered through the Ivorey platform (Ivorey Pty Ltd) and the Kollab App. The membership may also make use of other third party platforms from time to time, including but not limited to video conferencing tools and payment processors.

By joining, members acknowledge that:

  • Access to the membership depends on the Ivorey platform and Kollab App remaining available and operational

  • The Host is not responsible for any outages, technical issues, changes or discontinuation of services by Ivorey Pty Ltd or any other third party platform

  • Members may be required to agree to Ivorey's own terms of use and privacy policy when creating an account

  • The Host has no control over and accepts no liability for any third party platform's data handling, availability or service quality

  • Links to or use of third party platforms within the membership do not constitute endorsement of those platforms by the Host

If the Ivorey platform becomes unavailable for an extended period through no fault of the Host, the Host will make reasonable efforts to find an alternative delivery method. No refund is owed for temporary or isolated platform outages.

16. SERVICE INTERRUPTIONS

The Host will make every reasonable effort to deliver calls and content as scheduled. However, the Host is not liable for any loss, disruption or inconvenience arising from interruptions to the membership service, whether those interruptions are within or outside the Host's control.

Interruptions may include but are not limited to platform outages, internet failures, illness, personal emergencies or other unforeseen circumstances. Where a scheduled call cannot proceed, the Host will make reasonable efforts to reschedule or provide an alternative. No refund is owed for isolated service interruptions.

17. RECORDINGS AND PRIVACY

All group calls are recorded. By attending a live call, members consent to being recorded. Recordings are made available to all active members via the content library on the Ivorey platform.

Members should be mindful that anything shared on a live call will be captured in the recording and accessible to other active members. The Host encourages members to only share what they are comfortable having recorded and viewed by other members.

The Host is committed to handling all personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Personal information collected from members will only be used for the purposes of delivering and administering the membership.

18. DATA STORAGE AND MESSAGES

The Host does not guarantee the storage, delivery or retention of any messages, posts or other content shared within the community platform. Data storage is managed by Ivorey Pty Ltd and is subject to their own policies and limitations.

The Host is not liable for any loss of messages, posts or content arising from platform limitations, technical issues or decisions made by Ivorey Pty Ltd regarding data retention. Members are encouraged to keep copies of any important information they share or receive within the platform.

19. MEMBER INDEMNITY

By joining this membership, you agree to indemnify and hold harmless the Host, Alannah Aiken, from and against any loss, damage, cost or liability arising from:

  • Any breach of these terms by you

  • Any content you post or share within the community platform

  • Your failure to comply with any applicable law in your use of the membership

  • Any claim made by a third party arising from your conduct within or in connection with the membership

  • Any misuse of your account or login credentials


This indemnity continues after your membership ends.

20. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Host is not liable for:

  • Any loss, damage, injury or outcome arising from a member's participation in or use of the membership

  • Any action taken or not taken by a member as a result of content, coaching, community interaction or resources accessed through the membership

  • Any decisions made by a member based on information shared within the membership

  • The conduct, advice or actions of other members within the community

  • Any disruption to access caused by platform outages, technical issues or circumstances outside the Host's control

  • Any indirect, incidental, special or consequential loss of any kind

Where liability cannot be excluded by law, it is limited to the amount paid by the member in the most recent billing period immediately preceding the claim.

21. NON-DISPARAGEMENT

Members agree that if they have a concern or complaint about the membership, they will raise it directly with the Host in writing at alannah@alannahaiken.com before making any public statement.

Members agree not to make negative, defamatory or misleading public statements about the Host, the membership or the community on social media, review platforms or anywhere else while a concern is being worked through privately. If a concern cannot be resolved, members may share an honest account of their experience once the process in clause 22 has been followed.

22. COMPLAINTS AND DISPUTE RESOLUTION

If a member has a concern about any aspect of the membership, they agree to:

  • Raise the concern with the Host in writing at alannah@alannahaiken.com as soon as it arises

  • Allow the Host up to 10 business days to respond

  • Attempt to resolve the matter in good faith through direct communication before taking any further action

If the matter cannot be resolved directly, both parties agree to consider mediation before escalating to legal proceedings. The costs of mediation will be shared equally unless otherwise agreed.

23. GOVERNING LAW AND INTERNATIONAL MEMBERS

These terms are governed by the laws of Victoria, Australia. Any dispute arising from this membership will be subject to the jurisdiction of the courts of Victoria.

This membership is open to members outside of Australia. By joining, international members agree that Victorian law governs this agreement and that it is their own responsibility to ensure their participation complies with any laws, regulations or requirements in their country of residence. The Host makes no representation that this membership is appropriate or lawful in any jurisdiction outside Australia.

Nothing in these terms limits any rights a member may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).

24. CHANGES TO THESE TERMS

The Host reserves the right to update or amend these terms at any time. Members will be notified of any material changes at least 14 days before they take effect. Continued use of the membership after that date constitutes acceptance of the updated terms. The most current version of these terms will always be available on the membership platform.

25. GENERAL

If any part of these terms is found to be unenforceable, the remaining clauses continue in full force. A failure by the Host to enforce any provision of these terms at any time does not constitute a waiver of that provision. Any variation to these terms must be made in writing by the Host. These terms represent the entire agreement between the Host and the member in relation to the membership and supersede any prior representations or discussions.

ACCEPTANCE

By completing your membership registration and making your first payment through the Ivorey platform, you confirm that you have read, understood and agree to be bound by these Membership Terms and Conditions in full.
